Focused Business Partners covers most clients under our workers’ compensation master policy, with Focused BP as the policy sponsor. Workers’ Comp in Texas Is a Choice. Make It With the Right Partner

Texas is one of the few states where most private employers decide for themselves whether to carry workers’ compensation. That choice affects your risk, your costs, and how you handle an injury on the job.

You don’t have to buy coverage through us to work with us. We’ll cover you under our master policy if you qualify, and we’ll work with you either way.

What Texas Employers Should Know About Workers’ Comp

1

Coverage is optional

In Texas, private employers can choose whether to provide workers’ compensation coverage. Employers who don’t are called nonsubscribers (TDI).

2

Nonsubscribers have notice duties

Nonsubscribers must notify their workers and file notices with the Texas Division of Workers’ Compensation (TDI).

Under Texas PEO rules, workers’ comp is optional for a PEO too, and the service agreement must state which party maintains coverage (TDLR). Our agreements spell this out from day one.

Frequently Asked Questions

Do we have to get workers' comp through Focused Business Partners?

No. Workers’ comp through us is a strong option, but it’s never required. You can use our payroll, HR, and benefits services and handle workers’ comp on your own.

Do you work with Texas nonsubscribers?

Yes. If you choose not to carry Texas workers’ compensation, we’ll still work with you as your PEO.

How does your workers' comp master policy work?

Most of our clients are covered under one workers’ comp policy that Focused Business Partners sponsors. Your employees are covered under that policy instead of a separate policy in your company’s name.

What if our business doesn't qualify for your master policy?

Some businesses can’t be approved for our policy. If that happens, you can keep your own policy or remain a nonsubscriber, and we’ll still handle your payroll, HR, and benefits.

Is workers' compensation required in Texas?

For most private employers, no. Texas lets private employers choose whether to provide coverage. Employers that opt out are nonsubscribers and must give required notices to their workers and the state.
